LeaseConfirm™ Exclusive Listings Policy

1. Purpose 

LeaseConfirm™ provides a platform for landlords, property managers, and brokerages to market properties. This policy sets out the conditions for marketing exclusive listings on LeaseConfirm™ in compliance with the CREA REALTOR® Cooperation Policy and applicable real estate regulations.

2. What is an Exclusive Listing?

An Exclusive Listing is an agreement where a landlord or property owner gives one brokerage or agent the sole right to market their property.

Exclusive listings are typically marketed privately, but if you choose to market them publicly—including on LeaseConfirm™, social media, flyers, or other public platforms—the conditions in Section 3 apply.

3. Conditions for Public Marketing of Exclusive Listings 

3.1 MLS® Posting Requirement

If an exclusive listing is publicly marketed, the listing must be posted on a Multiple Listing Service (MLS®) System within three (3) calendar days of the first public marketing activity. This is a CREA-mandated rule.

3.2 Exemptions

Some property types may be exempt from the MLS® posting requirement, including:

  • Certain commercial properties
  • New construction developments
  • Rental listings

The listing brokerage is solely responsible for determining, confirming, and documenting whether an exemption applies before public marketing begins.

4. Responsibilities 

4.1 Listing Brokerages and Agents

  • Ensure compliance with the MLS® posting requirement.
  • Verify and document any exemption prior to public marketing.

4.2 Landlords, Property Owners, and Managers

  • By selecting an exclusive listing option on LeaseConfirm™, you confirm that you understand and agree to this policy.
  • If your property is publicly marketed, you acknowledge the MLS® posting requirement and agree to provide documentation of any applicable exemption if requested.

4.3 LeaseConfirm™

  • Provides a platform for exclusive listings.
  • May monitor listings to identify potential non-compliance.
  • Reserves the right to remove any listing that appears to breach this policy.
  • Is not responsible for enforcing MLS® compliance but expects all users to follow CREA rules and applicable regulations.

5. Monitoring and Enforcement 

LeaseConfirm™ may periodically review publicly marketed exclusive listings for compliance. If a listing is non-compliant, LeaseConfirm™ may

  • Remove the listing without notice, and/or
  • Require the listing brokerage or landlord to take corrective action immediately.

6. Amendments

This policy may be updated at any time to reflect changes to CREA rules or other legal requirements. Updates will be posted on the LeaseConfirm™ website, and continued use of the platform constitutes acceptance of the revised policy.
