📄 LeaseConfirm – Tenant Rent Payment Terms of Use

By using the LeaseConfirm platform to pay rent to your landlord (the "Service"), you agree to the following Terms of Use. Please read them carefully.

1. Acceptance of Terms

By accessing or using the rent payment feature on LeaseConfirm, you ("Tenant", "you") agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use this Service.

2. Description of Service

LeaseConfirm provides a platform for tenants to submit rent payments to their respective landlords through a secure third-party payment processor - Stripe. LeaseConfirm does not hold or manage tenant or landlord funds directly.

3. Eligibility

• Be the named tenant on a valid lease agreement;
• Be legally capable of entering into binding contracts;
• Provide accurate banking or card information to enable payment processing.

4. Payment Authorization

By using the Service, you authorize LeaseConfirm and its payment partners to:

• Process one-time or recurring rent payments as scheduled;
• Debit your bank account, debit card, or credit card in accordance with the payment terms you select;
• Share necessary payment details with third-party payment processors for the purpose of facilitating transactions.

You are responsible for ensuring sufficient funds are available at the time of payment. LeaseConfirm is not liable for overdraft fees or rejected transactions.

5. Fees

LeaseConfirm may charge processing or service fees for using the payment feature. All fees will be clearly disclosed prior to payment confirmation. By proceeding, you consent to such fees.

6. Non-Refundable Transactions

All rent payments are non-refundable once processed, except in the case of a verified system error. Disputes regarding rent amounts or terms must be resolved directly with your landlord.

7. Currency & Exchange

All transactions are processed in Canadian Dollars (CAD) unless otherwise stated. If paying with a non-CAD account, your bank or card issuer may apply foreign exchange rates and fees, which are your responsibility.

8. Payment Records & Receipts

LeaseConfirm provides electronic payment confirmation and receipts. You may access your payment history at any time through your LeaseConfirm dashboard.

9. Service Availability

LeaseConfirm aims to maintain 24/7 access but does not guarantee uninterrupted service. Maintenance, outages, or third-party disruptions may occur. We are not liable for any delays in rent transmission due to service interruptions.

10. Termination of Access

LeaseConfirm reserves the right to suspend or terminate your access to the rent payment feature for violation of these terms, suspected fraud, or non-compliance with your lease obligations.

11. Limitation of Liability

LeaseConfirm is not a financial institution or escrow service. We are not responsible for:

• Disputes between tenants and landlords;
• Late fees arising from delayed payments;
• Errors caused by incorrect tenant or landlord information.

Our liability is limited to the amount of service fees you have paid for the use of the payment feature in the last 30 days.

12. Amendments

LeaseConfirm may update these Terms of Use at any time. Continued use of the payment service after changes are posted constitutes acceptance of the updated terms.

13. Governing Law

These Terms are governed by the laws of the Federal Government of Canada and applicable Provincial laws within Canada.
